

Terms of Use — Diversity Whisperer

Binding agreement. By creating an account, booking, paying, or otherwise using this website or our services, you agree to these Terms and to our Privacy Policy.
1) What we do (plain language)
We provide neurodiversity-affirming coaching, workshops, and resources. We do not provide therapy, diagnosis, or medical/psychological treatment. Site content is educational; it is not medical, legal, or financial advice.
2) Eligibility & minors

You must have capacity to contract in your place of residence.

Coaching for minors requires a parent/guardian as the contracting party and consent (and participation as appropriate).

Where parental consent is legally required for young users, the parent/guardian must provide it.
3) Sessions, rescheduling, cancellations, refunds

Start = delivered: A session is deemed delivered at the scheduled start time or when begun.

≥ 24h: Reschedule/cancel 24+ hours before start for a full refund (if prepaid) or free reschedule.

< 24h / no-show : Up to 100% of the fee may be charged.

Subscriptions: Monthly plan with a 3-month minimum; after that, cancel anytime effective at the end of the current billing month.

Workshops/events: May carry specific terms shown at signup; those control if different.
4) Availability, support & planned breaks

WhatsApp chat support (fair use): For reasonable coaching-related questions and logistics. We aim to reply within 24 hours on working days, during working hours only. Weekend/holiday messages are handled the next working day.

Planned breaks: We may take leave for rest and professional development in December and during summer. We will give advance notice and offer rescheduling options.

No emergencies: WhatsApp, email, and Zoom are not emergency channels. If you or someone else is in danger, contact local emergency services immediately.
5) Payments, fees, taxes

Prices are in EUR unless stated otherwise and may change.

We accept Stripe, Payoneer, PayPal, and Wix Payments (availability may vary). Saved cards/“wallets” are handled by your payment provider; we do not store full card numbers.

Taxes: We collect and remit applicable taxes (incl. VAT) as required by law. You’re responsible for bank/FX fees.

Legitimate processor/chargeback fees may be passed through.
6) Communications & tools we use

Video calls: Zoom (and, if needed and agreed, WhatsApp video).

Chat/admin: WhatsApp and email.

Third-party services have their own terms and privacy notices. Your use of WhatsApp is subject to WhatsApp’s Terms and Privacy Policy; your use of Zoom is subject to Zoom’s Terms and Privacy Notice.
7) Transcripts & recordings

No video recordings.

Transcripts/notes: With your consent, we may create text transcripts/structured notes of sessions to summarize action steps and track progress. We can share summaries with you upon request. See the Privacy Policy for your choices.
8) Your responsibilities
Be respectful and lawful. Do not harass, discriminate, or share unlawful content. Do not disrupt sessions, attempt to access others’ data, or record sessions without explicit written consent from all parties. Keep your devices/accounts secure.
9) Intellectual property
All site content and materials are owned by Diversity Whisperer or licensors. We grant you a personal, non-transferable, non-commercial license to use materials for your own learning while these Terms apply. Do not copy, distribute, adapt, or sell our content without permission.
10) Security, third-party risk & data incidents
We use reasonable safeguards, but no system or platform (including WhatsApp, Zoom, email, or website providers) is 100% secure. You acknowledge and agree:

Third-party tools operate under their own security and policies outside our control;

You are responsible for securing your devices, passcodes, and networks;

If we become aware of a personal-data breach affecting you, we’ll follow our legal duties (see Privacy Policy).
To the fullest extent permitted by law, we are not liable for indirect or consequential losses caused by third-party service failures, account compromise due to your device/account security, or internet outages. Your mandatory consumer and data-protection rights remain unaffected.
11) Warranties & disclaimers
Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement. Coaching outcomes are not guaranteed.
12) Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/revenues/data/goodwill. Our total liability for any claim related to the services will not exceed the fees you paid for the relevant service in the 3 months before the event giving rise to the claim. This does not limit liability where such limitation is prohibited by law.
13) Indemnity
You agree to indemnify and hold us harmless from claims arising from your breach of these Terms or misuse of the site/services.
14) Changes
We may modify the site or these Terms at any time. Material changes will be posted with a new “Effective date.” Continued use means you accept the changes.
15) Disputes; consumer rights
These Terms operate alongside mandatory consumer protection laws that may grant you additional rights where you live. Nothing here limits those rights. The competent forum for disputes will be determined by applicable mandatory law.
